Terms of Service

Effective date: January 1, 2026

These Terms of Service (“Terms”) govern the provision of electrical contracting services by Safer Electric Inc. (“Safer Electric,” “we,” “us,” or “our”) to any individual or entity (“Client,” “you,” or “your”) engaging our services. By requesting, accepting, or permitting the commencement of any work, you agree to be bound by these Terms in their entirety.

1. Scope of Services

Safer Electric provides licensed residential, commercial, and industrial electrical contracting services throughout the Province of Ontario. All work is performed by or under the direct supervision of electricians licensed pursuant to Ontario Regulation 570/05 under the Trades Qualification and Apprenticeship Act and in strict accordance with the Ontario Electrical Safety Code (OESC) and all applicable municipal, provincial, and federal regulations.

Safer Electric holds ESA/ECRA Licence #7008996 and maintains active WSIB registration. Where required by the Electrical Safety Authority, permits shall be obtained prior to the commencement of work. Safer Electric also holds ESA Connection Authorization, permitting us to connect and energize electrical installations without requiring a separate ESA inspection in most circumstances.

2. Estimates, Quotations, and Pricing

Safer Electric provides free, no-obligation estimates upon request. Written quotations are valid for a period of thirty (30) calendar days from the date of issuance unless otherwise specified in writing. Estimates are based upon the conditions observed and information provided at the time of assessment.

Final pricing may differ from an initial estimate where the actual scope of work deviates materially from what was assessed — including, but not limited to, the discovery of concealed conditions, hazardous materials, code violations, or structural impediments. In such event, Safer Electric shall notify the Client and obtain written or verbal authorization prior to proceeding with any additional work or charges.

3. Payment Terms

Unless otherwise agreed in writing, payment is due in full upon completion of work. Accepted methods of payment include cash, certified cheque, electronic funds transfer (e-transfer), and major credit cards (Visa, Mastercard, American Express).

For projects exceeding $2,500 in estimated value, a deposit of up to thirty percent (30%) may be required to confirm scheduling and procure materials. All deposits are non-refundable in the event of cancellation with fewer than forty-eight (48) hours' notice. Outstanding balances not paid within thirty (30) days of the invoice date may be subject to interest at a rate of 1.5% per month (18% per annum) on the unpaid balance.

4. Warranty and Workmanship Guarantee

All labour performed by Safer Electric is warranted for a period of one (1) year from the date of substantial completion. This warranty covers defects in workmanship and installation and obligates Safer Electric to repair or correct, at no additional charge, any work found to be defective during the warranty period.

Manufacturer warranties on materials, equipment, and fixtures vary by product and are passed through to the Client in accordance with the manufacturer's terms. This warranty does not extend to damage resulting from misuse, unauthorized modification, neglect, Acts of God, or conditions beyond Safer Electric's reasonable control.

5. Cancellation and Rescheduling

Clients may cancel or reschedule a confirmed appointment by providing at least twenty-four (24) hours' advance notice. Cancellations made with fewer than twenty-four (24) hours' notice may be subject to a service call fee to cover administrative and scheduling costs. Emergency service appointments are exempt from this policy. Safer Electric reserves the right to cancel or reschedule work in circumstances of inclement weather, supply chain delays, or other factors beyond our control.

6. Access and Site Conditions

The Client shall provide Safer Electric with safe, unobstructed access to all areas where work is to be performed and to the electrical distribution system, including the main service entrance and panel. The Client is responsible for ensuring that work areas are clear of personal property and obstructions. Safer Electric shall not be liable for delays or additional costs arising from the Client's failure to provide adequate access or to disclose known hazards or conditions.

7. Limitation of Liability

To the fullest extent permitted by the laws of the Province of Ontario and the federal laws of Canada applicable therein, Safer Electric's aggregate liability arising out of or in connection with the services provided shall not exceed the total value of the work performed under the applicable contract or work order.

In no event shall Safer Electric be liable for indirect, incidental, consequential, special, or punitive damages — including, without limitation, loss of profits, loss of use, business interruption, or damage to property not forming part of the contracted work — except where such damages are attributable to the gross negligence or wilful misconduct of Safer Electric. Safer Electric maintains comprehensive commercial general liability insurance and WSIB coverage for the protection of its clients and employees.

8. Dispute Resolution

Any dispute arising out of or in connection with these Terms or the services provided shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached within thirty (30) days, the dispute shall be submitted to mediation in the City of Toronto, Ontario, in accordance with the rules of the ADR Institute of Ontario. The laws of the Province of Ontario shall govern the interpretation of these Terms.

9. Amendments

Safer Electric reserves the right to amend these Terms at any time. The most current version shall be posted on our website. Continued engagement of our services following any amendment constitutes acceptance of the revised Terms.
